Terms of engagement

The basis on which the practice accepts instructions.

These are draft summary terms prepared for the website. Full terms should be settled with a suitably qualified adviser and issued with each proposal before any engagement begins.

Proposals and fees

Every engagement is preceded by a written proposal setting out the services to be provided, the named consultant, the fee and the basis on which it is calculated. Fees are fixed unless the proposal states otherwise. Work does not commence until the proposal is accepted in writing.

Scope

The practice provides advice within the scope defined in the proposal. Advice given for one project or set of circumstances should not be relied upon for another without confirmation.

Client responsibilities

  • Providing accurate and complete information about the works, the site and existing arrangements
  • Providing safe access where site attendance is required
  • Notifying the practice of material changes to the works or the programme
  • Implementing the arrangements the practice advises, or recording the reasons for not doing so

Duty holders

The practice advises duty holders. It does not assume the client's statutory duties, which remain with the client at all times unless a specific appointment states otherwise in writing.

Insurance

The practice maintains public liability insurance. Certificates are supplied on request.

Confidentiality

Information about a client's projects, personnel and arrangements is treated as confidential and is not disclosed to third parties except where required by law, by an enforcing authority, or with the client's consent.

Payment

Invoices are payable within the period stated in the proposal. Interest may be charged on overdue amounts in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

Governing law

Engagements are governed by the law of England and Wales.
